    PRAVO NA PRIVATNOST U RADNOM ODNOSU I EVROPSKA KONVENCIJA O LJUDSKIM PRAVIMA

    Pravo na privatnost u radnom odnosu i zaštita privatnosti radnika uopšte dobijaju sve veći značaj u savremenom društvu zasnovanom na informacijama i znanju. U uslovima tektonskih promena u svetu rada, koje obuhvataju savremene tehnologije i oblike komunikacije, menjaju se i oblici nadzora i kontrole koje poslodavci vrše u procesu rada. Novi oblici nadzora i kontrole preko kojih poslodavci vrše upravljačka ovlašćenja u radnom odnosu obuhvataju različite oblike elektronskog nadzora korišćenja računara (npr. pristup internetu, elektronskoj pošti), telefona i mobilnih telefona, video-nadzor, praćenje lokacije na kojima se zaposleni nalaze i tako dalje. Savremeni pravni sistemi se suočavaju sa sve većim izazovima u uspostavljanju odgovarajućeg nivoa ravnoteže između zaštite osnovnog prava na privatnost radnika, s jedne strane, i imovinskih prava i prerogativa upravljanja poslodavaca, s druge strane. U tom pravcu se sve češće postavljaju dileme o dozvoljenosti mešanja, odnosno zadiranja poslodavaca u privatnu sferu radnika, kao i o granicama takvog mešanja. U ovom radu, pravo na privatnost u radnom odnosu analizirano je kroz prizmu propisa Saveta Evrope (pre svega čl. 8. Evropske konvencije o ljudskim pravima) i jurisprudencije Evropskog suda za ljudska prava. Autori se osvrću na dva važna pitanja: obim prava na privatnost u kontekstu radnog odnosa i obim zaštite od ometanja prava na privatnost radnika.

    Konvencija Br.190 Međunarodne Organizacije Rada Naspram Makedonskog Pravnog Okvira za Zaštitu od Nasilja I Uznemiravanja na Radu

    Posle višegodišnjeg zalaganja različitih interesnih grupa na globalnom planu za uspostavljanje medžunarodnog instrumenta za rad bez nasilja i uznemiravanja, Medžunarodna konferencija rada je na 108. zasedanju 2019. godine usvojila dva medžunarodna standarda (Konvencija br.190 i Preporuka broj 206) u cilju sprečavanja i eliminacije nasilja i uznemiravanja u svetu rada. Sadržaj Konvencije br.190 strukturiran je iz nekoliko delova. U okviru rada autori se osvrcu na delove Konvencije koji se odnose na definicije, obim, zaštitu i prevenciju, te sprovodženje i pravne lekove, kao i stepen njihove (ne)usaglašenosti sa domačim zakonodavstvom. Konvencija br.190 još uvek nije ratifikovana u Skupštini Republike Severne Makedonije. Medžutim več u martu 2021. socijalni partneri (predstavnici radničkih organizacija, poslodavca i Vlade) predstavljeni u Ekonomsko-socijalnom savetu doneli su jednoglasnu podršku za njenu ratifikaciju.

    The ‘gray’ area between employment and self-employment: legal approaches to formalizing informal work and reducing precariousness in the context of Macedonian labour law

    The term ‘gray area’ is commonly used in literature to describe the space that is created between ‘dependent’ work (employment) on the one hand, and ‘autonomous’ work (selfemployment) on the other, and it usually refers to the following types of work: bogus selfemployment or disguised employment relationship; intermediate, i.e. objectively ambiguous forms of work (e.g. dependent self-employment); certain forms of work that involve multiple parties (e.g. contracting-out or labour dispatch) and casual work. North Macedonia is on the verge of adopting a new Labour Relations Law. In that regard, dilemmas that are becoming increasingly relevant are: ‘what is the course taken by the Macedonian labour law system concerning the global debate on redefining the boundaries of the traditional binary system and expanding the protective framework of labour legislation’? ‘what types of nonstandard forms of work that occupy the gray area between employment and self-employment can be recognized in the Macedonian legislation and practice’? ‘whether and what regulatory measures should be taken to address the disguised and objectively ambiguous forms of work and what are the prospects for introducing new non-standard forms of work intended to formalize informal employment and reduce precariousness’? Having in mind the previous dilemmas, the purpose of this paper is to analyze the current situation, but also to address the trends and perspectives of Macedonian labour legislation in the context of contemporary challenges in the world of work

    The approach of EU labour law in redressing the problems of working parents and carers

    The conflict between employment and family responsibilities, that is, private life in general, is regarded as one of the most pressing concerns of labour law over an extended period. In the context of increasing participation of women in labour markets, ageing of the population and changes in the archetypal forms of employment relationships and families, the issue of reconciling work with family life, i.e. maintaining the work-life balance, affects all social actors: workers, employers and governments. In light of this, the paper first analyses the EU policies and legislative measures related to the special protection of women in relation to pregnancy and maternity, including the right to maternity leave. Additionally, it addresses the special rights of working parents, including the right to parental leave for both men and women workers. Finally, the paper looks at the most recent EU Directive on Work-Life Balance of 2019, providing a critical review of both the newly introduced rights in the Directive, such as paternity and carers’ leave, and the already established rights of parental leave and flexible working arrangements.
