Item type:Publication, The challenges involved in teaching about the Rule of Law as a fundamental value of the EU system(Springer, 2023)Cenevska, IlinaIn the face of the ongoing rule of law backsliding developments in the Union, it has become a challenge for educators at EU and non-EU universities who teach about the rule of law as an EU value to fully deliver the rule of law ‘message’ to their students. This chapter will firstly elaborate on the importance of the rule of law as a baseline principle of the EU framework, providing insight into the current state of play regarding the EU’s rule of law issues. Secondly, the analysis will weigh in on the most appropriate methodological approaches to be employed in the university-level instruction covering the fields of EU Law and EU studies more broadly. Thirdly, the chapter will specifically look into the most suitable and most effective methodological tools for teaching the rule of law as an area of study. Lastly, conclusions will be drawn about the ways in which educators can improve the methodological toolkit they utilize when teaching about the rule of law as an EU value as well as a general concept, such that would allow students to internalize their knowledge of the different components of the rule of law and, as a result, be prepared to successfully apply this knowledge to practical, real-world situations. - Some of the metrics are blocked by yourconsent settings
Item type:Publication, (На)враќање кон основите: Начелото на примат (супрематија) на правото на Европската Унија во светлото на актуелните случувања(Macedonian Lawyers Association, 2022-02)Cenevska, IlinaThis article revisits the principle of primacy of European Union law as one of the fundamental legal principles which have enabled the process of European legal integration and upon which the legal order of the Union rests. The analysis aims to provide a fresh look at the principle of primacy, taking into account the latest developments in the European Union – most notably, the judgment of the Polish Constitutional Tribunal delivered on 7 October 2021, as one that strongly resonated within the European circles. The Polish Constitutional Tribunal’s judgment directly challenged the validity of the principle of primacy by declaring specific provisions of the Union Treaties to be incompatible with the Polish Constitution. Taking this into account, one could arguably claim that the uniform observance and application of the principle of primacy by the Member States is currently facing its most serious challenge to date. What are the legal implications resulting from this and similar such decisions delivered by the Member States’ constitutional courts, and to what extent do these have the potential to jeopardize the unity and the autonomy of the Union legal order?
